  1. IDENTITY AND ADDRESS OF THE DATA CONTROLLER .

This Privacy Notice (hereinafter “Notice”) sets forth the terms and conditions under which Trading4relief, S. de R.L. of CV, hereinafter “T4R”, with residence in Monterrey, Nuevo Leon, Mexico, in its capacity as Data Controller, will process the personal data that concerns you as the owner of your personal data, in order to protect your privacy and your right to information self-determination, as provided for in the Federal Law on the Protection of Personal Data possessed  by Private Persons (the “LFPDPPP”), its Regulations and the Guidelines of the Privacy Notice issued by the Ministry of Economy (the “Ordinances”).

  1. DEFINITIONS

For purposes of this Notice, the definitions of the terms “Personal Data”, “Sensitive Personal Data”, “Days”, “Process”, “Data Subject”, “Data Controller”, “Data Processor”, “Transfer”, ” ARCO Rights “-” Right of Access “,”Right of Rectification”,” Right of Cancellation “,” Right of Opposition “; “Cookies”, “Web Beacons”, as well as the other elements provided in the Notice will have the same meaning as that attributed in the Ordinances.

  1. PERSONAL DATA WE COLLECT AND TREAT

In T4R we collect and process the personal data that are indicated below:

Customers

  1. a) General information

Name and surnames, email address.

  1. b) Tax data

Key and Folio of the Federal Taxpayer Registry, as well as fiscal address.

c)Sensitive personal information

At T4R we do not collect or process personal information about you.

d)Personal data from sources of public access and received via consented transfers

Data from public records, directories, social networks and other legal sources available in the market, as well as personal data that have been shared by third parties to which you had previously authorized.

  1. PURPOSES

In T4R we process your personal data in order to carry out the activities and procedures aimed at complying with the obligations arising from any commercial and or legal relationship that we establish with you and that we consider primary purposes, which include:

  1. i) Allow your access to our website;
  2. ii) Request, buy, change, or return products;

iii)Request, contract, change or cancel services;

  1. iv) Register in our customer database;

v)Assign a customer number;

  1. vi) Manage the payment of products and / or services;

vii) Manage digital tax receipts;

viii) Request a quote, product and service information;

  1. ix) Request delivery, repair or fulfillment of product warranty;
  2. x) Request the provision of services or fulfillment of service guarantee, and
  3. xi) Integrate your file.

Additionally, we will treat your personal data for other secondary purposes, which do not originate or are necessary for the legal and / or commercial relationship that we establish with you, which include:

  1. i) Contact the Customer Service Department;
  2. ii) Manage your purchase history and other operations

iii) Share your comments, suggestions, complaints and clarifications about our products and services;

  1. iv) Evaluate the quality of our products and services through various instruments, including surveys;
  2. v) Implement activities aimed to promoting, maintaining and improving our products and services;
  3. vi) Participate in chats, public walls of social networks, and / or discussion forums;

vii) Notify T4R about problems with your site;

viii) Send notices of offers, notices and / or advertising, promotional, commercial prospection or marketing purposes in electronic media;

  1. ix) Use the different services of their corresponding Websites;
  2. x) Allow the management, administration and security of your personal data;
  3. xi) Maintain electronic and procedural safeguards of your personal data in terms of applicable legislation and regulation, and

xii) Comply with the applicable legal requirements.

  1. CONSENT OF THE DATA SUBJECT.

For purposes of the provisions of the Ordinances, by these means you declare: i) that this Notice has been made available to you by T4R prior to the collection and / or processing of your personal data, ii) that you have read, understood and agreed the terms set out in this Notice for the collection and processing of your financial or patrimonial  data, so that, if you provide them, you will include your name and signature in the handwritten form of this document that must be digitized, or, you will express your consent through the dialogue windows enabled on our websites. The foregoing, based on articles 8 and 9 of the LFPDPPP, as well as on articles 11, 12, 14, 15 and 16 of the Regulations, without prejudice to the exceptions provided for in articles 10 and 37 of the LFPDPPP that empower us to process your personal data and transfer them in order to comply with our obligations derived from the law, from contractual terms, or by virtue of  current and / or future legal relationship that we have or that we will have with you.

For the collection, processing and transfer of your personal data, which are not financial or patrimonial, you will provide us with your tacit consent under the terms of this Notice by not objecting or opposing its content within the next 48 hours after your personal data are collected and this notice has been made available through different means, including its publication on our website.

  1. TRANSFERS OF DATA TO THIRD PARTIES.

T4R may use your personal data to offer you, if necessary, other services directly or through its commercial partners, in Mexico and or abroad, or through third parties subcontracted for this purpose. We can also send you promotions of other goods or services related to the services described in the previous sections, being such purposes  not essential for the fulfillment of the legal relationship with you and that gave origin  to the services provided, which you may object within a period of 5 days following the date on which your personal data have been processed by T4R.

The third recipients of your personal data, are bound by virtue of the corresponding contract, to maintain the confidentiality of the personal data provided by T4R and to observe this Notice.

  1. PROCEDURE TO EXERCISE ARCO RIGHTS AND REVOCATION OF CONSENT.

At all times you have the right to access, rectify and cancel your personal data, as well as to oppose to the processing thereof or to revoke your consent regarding the processing  for certain purposes – including secondary ones – that you would have authorized at the time, directly or through your legal representative, for which you must submit the corresponding request – using the formats that we will make available through our Data Protection Officer via e-mail, with the information and documentation that is indicated below:

  1. Full name, address or other means – such as your email address – to communicate the response to your request;
  2. Documents proving your identity – simple copy in printed or electronic format of your voter’s credential, passport or Visa, as applicable, or as the case may be, of the legal representation of your client – simple copy in printed or electronic format of the proxy letter with your handwritten signature, that of two witnesses and the legal representative, with their corresponding official identifications – voter’s credential, passport or Visa);
  3. Clear and precise description of personal data with respect to those seeking to exercise any of the ARCO rights; and
  4. Any other element or document that facilitates the location of your personal data.

In the case of requests for access to personal data, T4R will proceed with the delivery of your information, via electronic means, after proof of your identity or that of your legal representative, as applicable.

In the case of requests for rectification of personal data, you must also indicate the modifications to be made and provide the documentation supporting your request.

T4R will respond within a maximum period of twenty days, counted from the date on which it receives your request for access, rectification, cancellation or opposition, the determination that it adopts, so that, if it is appropriate, it becomes effective within fifteen days following the date on which you communicate your response. In all cases, the response of T4R will be given to you by the way you have chosen when submitting your application, or in its case, by any other means agreed with you. The aforementioned periods may be extended once for an equal period, as long as the circumstances of the case justify it, as provided  in the LFPDPPP.

The delivery of personal data will be free of charge, it will only cover the justified shipping costs or the cost of reproduction of copies or other formats. In the event that you repeat an application within a period of less than twelve months, you must cover the corresponding costs in terms of the LFPDPPP, unless there are substantial modifications to the privacy notice that motivate further consultations.

For the reception, registration, attention and response of requests to exercise your ARCO rights and the other rights provided in the LFPDPPP, we make available for you the Data Protection Officer, which you may contact in the offices indicated in the section 8, or, through our website, or via email.

In case the information provided in your application is erroneous or insufficient, or the corresponding accreditation documents are not accompanied, we can request, within the following five days after receiving your request, to provide the necessary elements or documents to process it. You will have ten days to meet our requirement, counted from the day after you received it. If there is no response within that period, the corresponding request will be deemed as not filed.

  1. LIMITATION OF USE AND DISCLOSURE OF INFORMATION.

T4R will keep your personal data for as long as it is necessary to manage the commercial and / or legal relationship with you, as well as to maintain the records required by the LFPDPPP, its Regulation, the applicable commercial, administrative and tax legislation.

The personal data collected by T4R is protected by adequate administrative, technical and physical security measures against damage, loss, alteration, destruction or unauthorized use, access or processing, in accordance with the provisions of the LFPDPPP and its Regulations.

Likewise, you can choose to be excluded from our distribution list of emails using the dialogue windows enabled for that purpose on our website. You can also register in the Public Registry of Consumers of the Federal Attorney’s Office ((http://rpc.profeco.gob.mx/) to avoid receiving telephone calls with advertising communications, promotions and / or other offers of products and services.

Collection of data when browsing the T4R websites

T4R can collect personal data through its website, or through the use of automatic data capture tools. Within the automatic data capture tools used by T4R on their websites are cookies, Web Beacons, and links in emails.

Use of Web Beacons.- Also known as Internet tags, pixel tags and clearGIFs.) .- T4R can use Web Beacons on their websites and in their HTML emails, alone or in combination with cookies, to collect information about the use of the Websites and their interaction with the electronic mail. The Web Beacon is an electronic image, called a single pixel (1×1) or GIF that can recognize information that is processed on your computer, such as cookies, the time and date when the site and its sections are displayed.

Links in the emails of T4R.- The emails that include links that allow T4R to know if it activated that link and visited the web page of destination, this information can be included in its profile.

Protection of minors, persons in a state of interdiction or incapacity: T4R does not collect or process personal data of minors, persons in an interdicted or incapacitated state and encourages parents and / or guardians to take an active role in the online activities of their children. children and / or represented.
