Trading4relief, S. de R.L. de CV, is a company duly incorporated under the laws of the Mexican Republic, with residence in Av. Revolución 2703 GN-1505, Col. Ladrillera, C.P. 64830, Monterrey, Nuevo León, México, which we will be referred hereinafter as “T4F” which is the company in charge of the management of the Website www.tradingforrelief.com and the Associated Websites.
OBJECT AND SCOPE. These Terms and Conditions (hereinafter, the “T&C”) are intended to regulate the activities developed in our Website www.tradingforrelief.com and as appropriate, on our Associated Websites, including but not limited to: i) the sale of the book “Trading for Relief” by Daniel Figurka, whether in its printed and/or digital format; ii) consultation of online information related to the content of the book “Trading for relief” through a membership; iii) the offer and sale of other products and / or services of T4R; iv) discussion forums, chats and public walls on social networks; v) promotions; vi) the sending of promotional and telemarketing communications of our products and services, through our website and our Associated Websites, visible through the different applications and electronic devices; vii) the other services that will be enabled in the future on the site and / or our Associated Websites (which together will be referred to as the “Online Services”).
Some of the Online Services require diverse previous registration acts that involve the provision of personal data from you (who will be referred to hereafter as “User”) according to the requirements provided in the Dialogue Windows of the Website or the Associated Websites. In addition to the present T&C, the use of the Website and the Associated Websites will also be subject to the other T4R Policies and Notices, including our Privacy Notice and the other policies that may be issued in the future; which are here reproduced as if they were included in text ; as well as the instructions published at T4R Website and / or the Associated Websites.
SOME DEFINITIONS. To facilitate the reading of the present T & Cs, we ask you to consider the following definitions:
CATALOG OF PRODUCTS AND/OR SERVICES.- Framework document in electronic format that describes the PRODUCTS AND/OR SERVICES offered by T4R and that informs about its characteristics, price, warranties, forms of payment and any other related and relevant information that is available to the CLIENT on the website www.tradingforrelief.com for consultation;
CLIENT.- any person who, by paying the appropriate price, acquires or enjoys the PRODUCTS AND/OR SERVICES offered by T4R through the Website www.tradingforrelief.com and on the Associated Websites;
ASSOCIATED WEBSITES.- Refers to any T4R website, as well as to the following sub-accounts of the social network sites in which T4R participates as a user: Trading for Relief on Facebook, @tradingforrelief on Twitter, tradingforrelief on Instagram.
ONLINE SERVICES.- Refers to the activities carried out on the website www.tradingforrelief.com and in the sub-accounts of the social networking sites described in the previous section;
USERS.- are the visitors to our Website and our Associated Websites that use the Online Services;
DIALOGUE WINDOWS.- Electronic forms of the Website www.tradingforrelief.com, as well as the associated Websites in which the User provides their personal data and the necessary information for the provision of the Online Services.
UPDATES. You agree to periodically review these T&C, since these can be modified at any time by T4R, which will be informed on our Website through a prominent notice. Some of the Online Services available to the User have accessible administration and management facilities that require the use of codes and passwords (“User Name” and “Password”), which may be attributed by T4R or selected by You, to verify your identity as a User. You acknowledge that any operation correctly identified with such codes and passwords will be considered as validly performed by you as a User. Therefore, you must refrain from revealing those codes and passwords to other people, making personal use of them, and if you knew that another person had accessed to them or had accessed the Website www.tradingforrelief.com, as well as the Associated Websites, with your access codes and passwords, without your consent, you must notify immediately and in writing to the email address contacto.claves@tradingforelief.com about such circumstance.
PRODUCT PURCHASE. By accessing a Dialogue Window in which the Products are offered for sale, when you enter the entire information and personal data that are required and when you accept a sale offer, a purchase will be taking place, and provided there is availability of the product. Product, T4R will deliver to the Client the quantity of pieces of the Product chosen by the Client and that are indicated in the Dialogue Window as “Pieces / Quantity of the Product”, provided that the Price determined in the Catalog of Products and Services is accredited by the client or duly delivered to T4R. It is important that you consider that in any sale of Products that has place through the Website www.tradingforrelief.com it will be understood that the Client knows the characteristics and limitations of the Product specified in the corresponding sections of the Catalog of Products and Services, and that The Client accepts the terms in which the product and/or the service has been offered to him/her. All the charges that are made for the “Price of the Product/ Service” will add the Value Added Tax, as well as the shipping costs. In any case, the total amount to be paid will be broken down in the corresponding section of the Catalog of Products and Services and may be expressed in US dollars with its equivalent to the exchange rate in national currency published on Paypal´s Website. The Price must be covered by the Client prior to the delivery of the Product(s), through the payment made to T4R through PayPal´s payment platform. In connection with any payment made by you to T4R, you may process the digital tax invoice on the website designated by T4R, which will cover all the requirements of law, provided that it is processed within the following 5 working days from the date on which the payment was made.
RESCISSION OF THE PURCHASE. You can cancel the purchase of the requested PRODUCTS AND/OR SERVICES through the Website www.tradingforrelief.com without charge or liability, provided that the cancellation is made within the following five days after the date you purchased the Product. and/or Service and you had not used the Product and it is in perfect state. The cancellation must be manifested through the corresponding Dialogue Window or by email directed to contacto.cancelacion@tradingforelief.com. T4R will refund the amount of the paid price once the Product has been recovered by its staff, with a deduction equal to the costs related to the shipment.
EARLY TERMINATION OF THE MEMBERSHIP. In the event that you decide to cancel your membership, the amount that you have paid to T4R for the current membership, will be applicable to cover administrative costs, and the reimbursements of such amounts will not proceed.
WARRANTY. The Products and Services have a guarantee of 60 days, counted from the date of delivery of the Product and/or the Service. The guarantee covers any manufacturing defect or damage of origin of the Product. The guarantee must be asserted by the Client by sending an email directed to contacto@tradingforelief.com or through the corresponding Dialog Window enabled on the Website www.tradingforrelief.com. The warranty does not cover any repair or modification made by a third party to the Product. The expenses incurred by the Client to make the guarantee valid in a home different from that of T4R, must be covered by the Client.
OBLIGATIONS OF T4R: T4R undertakes to deliver to the Customer in a timely manner the Products and/or Services selected by the Client in the Catalog of Products and Services, as well as to provide the Products and/or Services requested by the Client through the Dialogue Window, in the agreed times and under the agreed conditions, but always subject to the availability of the Product and/or Service for delivery in national territory.
OBLIGATIONS OF THE USER/CLIENT: You are obliged to make the corresponding payments to the price of the Product and/or Service, as well as the the value added tax, the shipment expenses, and the other expenses that are included and broken down in the Digital Tax Invoice . The total amounts to be paid may be expressed in US dollars with their equivalent to the exchange rate in national currency published at Paypal´s Website, and include the value-added tax and any other associated cost. You can make the payment through the mechanisms enabled on the Website www.tradingforrelief.com, including the Paypal payment platform. You agree to send via email to contacto.facturacion@tradingforelief.com, or through the Dialogue Windows enabled on the Website, a digital copy of your official identification (voter’s credential, passport or visa); in the case of legal persons, in addition to the previous documentation of the legal representative, a digital copyof the articles of incorporation and the power of attorney of the legal representative. Identity documents will not be necessary if the Client’s emails are signed with an advanced digital signature, protected by a valid digital certificate issued by a certification service provider duly accredited by the Ministry of Economy.
OTHER ONLINE SERVICES: T4R may enable on the Website www.tradingforrelief.com discussion forums and chats to provide information to Clients or to answer your questions and/or specific requests. Likewise, promotions, trivia, contests, loyalty programs, could be implemented, their requirements and rules will be detailed in the corresponding section of the Website. Regarding discussion forums and chats, we inform you that some of them are moderated, and that all are subject to access by a representative of T4R for technical reasons. T4R does not control the content that Users may include, since some are public discussion forums. As in any interactive forum open to many Users, you should carefully consider whether you wish to provide the information and your personal data, since such forums are considered public and T4R will not be responsible for the use and disclosure of the personal data that you disclose in such forums.
